These Terms govern your access to the GameDay Creator Network (the "Portal"), operated by GameDay Agency ("GameDay", "we", "us"). By creating an account or using the Portal you agree to these Terms. If you do not agree, do not use the Portal.
The Portal is invite-only. You must be at least 18 years old and hold a valid invitation. We may suspend or remove access at any time, for any reason.
You are an independent creator, not an employee, agent or partner of GameDay. Nothing in the Portal creates an employment, partnership or joint-venture relationship, and no earnings, growth or results are promised or guaranteed.
You agree not to:
Report anything that breaks these rules using the Report options in the Portal. Do not knowingly submit false or misleading reports or retaliate against anyone who makes a good-faith report. We may review relevant account activity and content, but we do not promise a particular response or resolution.
No alcohol or drugs may be shown, used or promoted by you or anyone on your LIVE. This rule is intended to protect your account, business and income. TikTok may restrict, suspend, ban or permanently close accounts that violate its rules, and violating this requirement may result in removal from the GameDay Creator Network. You may be required to acknowledge this rule before posting or accepting a collab.
Collabs, private conversations, channel messages, support conversations and meetings between members are arranged at your own risk. GameDay does not screen, supervise or guarantee any member, and is not responsible for member conduct on or off the Portal. Use good judgment and never share passwords, financial details or sensitive information in messages. Staff may review reported or support-related content for safety, support and moderation.
You keep ownership of messages, posts, profile information, images, documents and other content you submit. You grant GameDay a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display and use that content as reasonably necessary to operate, secure and moderate the Portal. You confirm that you have the rights and permissions needed for anything you submit. We may restrict or remove content that violates these Terms, another person's rights or applicable law.
Scout applications, referrals, bonuses and payouts are subject to additional eligibility requirements, the Scout Rules and the separately signed Scout Independent Contractor Agreement. If those documents conflict with these Terms regarding Scout services, the Scout Independent Contractor Agreement controls. Referral credit, bonus eligibility and payout calculations are determined under that agreement and GameDay's records. No Scout Bonus rate is promised by these Terms.
The Portal may offer an Apple or Google Wallet membership card and may send announcements, support replies, mentions, collab requests, Scout updates and similar notices through that card or other channels. These features are optional conveniences. Delivery may be delayed or fail, and notifications are not a substitute for checking the Portal. You are responsible for controlling lock-screen and wallet notification settings on your device.
Training, resources and support are provided for general information only and are not legal, financial or tax advice. You are responsible for your own content, accounts and compliance.
You consent to receive agreements, notices and records electronically. When the Portal asks you to type your legal name, draw a signature, check an acknowledgement or submit an acceptance, you agree that action may serve as your electronic signature or record of consent to the extent permitted by law. You may download documents made available to you in the Portal.
THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PORTAL WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, GAMEDAY AND ITS OWNERS, EMPLOYEES AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR FOLLOWERS, ARISING FROM YOUR USE OF THE PORTAL OR ANY INTERACTION WITH OTHER MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).
You agree to defend, indemnify and hold harmless GameDay and its owners, employees, contractors and partners from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising from your content, your use of the Portal, your interactions with other members, or your breach of these Terms or any law.
We may investigate conduct and restrict, suspend or terminate access, remove content, disable Scout or referral privileges, or revoke associated wallet cards when reasonably necessary to enforce these Terms, protect the community or comply with law. Termination does not erase obligations, liabilities or records that by their nature should survive, including content licenses, payment obligations, disclaimers, liability limits, indemnification and dispute terms. Data may be retained as described in the Privacy Policy.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be resolved by binding individual arbitration, and you waive any right to participate in a class action, to the extent permitted by law.
We may update these Terms and will post the revised date above. Where required, we may ask you to accept material changes. Questions may be sent to info@gameday.agency.
